Terms of use

Pear is an iPhone app made by Phanthawas Jirakiattikun. These terms are short on purpose.
1. The licence
Pear is licensed to you under Apple's Licensed Application End User License Agreement (the Standard EULA). That agreement is the licence for the app. These terms add only what's specific to Pear, and where they differ on the licence itself, the Standard EULA wins.
2. Free download and trial
Pear is free to download. Every feature is free for 14 days from the moment your Pair is created. After that, sending Pips and the widgets pause until one of you buys the unlock. Viewing Memories, exporting and Unpearing are always free.
3. The one-time unlock
- It's a single, non-consumable in-app purchase, not a subscription. You pay once and are never billed again.
- One purchase by either Pear unlocks Pear for both Pears in that Pair, for as long as the Pair exists.
- The purchase belongs to the Apple Account that bought it. If you Unpear and pair with someone new, it unlocks your new Pair too. You can restore it on any iPhone signed in to that account.
- Apple sells it and handles payment, tax and refunds, under the App Store's terms. The price is shown in the App Store before you buy. To ask for a refund, use Apple's Report a Problem.
4. What you share
What you create in Pear is yours. You're responsible for what you send, so only send things you have the right to share, and nothing unlawful. Pear has zero tolerance for objectionable content and abusive users: if your Pear sends you something abusive, Unpear (at the bottom of the Us tab) ends the Pair right away and stops them sending you anything, and you can report it to us from Us › About Pear › Report a Concern. We answer reports within 24 hours. We can't see your Pips or anything else you share, so we can't review or recover them for you. Export your Memories if you want a copy you control.
5. iCloud
Pear needs iCloud. Everything you share is stored in the iCloud account of the Pear who sent the invite and is subject to Apple's iCloud terms. We aren't responsible for iCloud outages, storage limits or data lost by iCloud.
6. No warranty
Pear is provided as is. We work hard to make it reliable, but we don't promise it will always be available or free of errors, or that notifications and widgets will update at any particular speed.
7. Liability
To the extent the law allows, our total liability for anything to do with Pear is limited to what you paid for it, and we aren't liable for indirect or consequential loss, including lost data. Nothing here limits rights you have as a consumer that can't be limited by law.
8. Changes
We may update these terms for future versions of Pear. We'll change the date at the top when we do.
9. Governing law
These terms are governed by the laws of Thailand. This doesn't affect consumer-protection rights you have where you live.
